We are a United States company, located in the United States, and we operate from the United States. Your data is collected, stored and processed in the United States.
We do not have a Spanish tax ID or any EU establishment, because we are not an EU entity. If you are in the European Union, the EU General Data Protection Regulation (GDPR) still protects you and still binds us: it applies to us through Article 3.2, because we offer our services to people located in the EU.
Only what you type into the form, plus the record that it was you who submitted it:
We keep that proof for one specific reason: the GDPR requires us to be able to demonstrate that you gave us your consent (Article 7.1). Without that record we could not demonstrate it, and you would have no way of checking exactly what you accepted.
We do not profile you, and we never sell or share your email with third parties for their own marketing.
We process your data based on your consent (Article 6.1.a GDPR): you sign up yourself, by ticking the consent checkbox freely and voluntarily. That consent also covers your data being sent to and processed in the United States, which we explain in section 5.
How we prove that consent existed. We do not use a confirmation email. Instead, at the moment you submit the form we automatically record the proof described in section 2. That record is attached to your contact record and we can show it to you if you ask.
You can withdraw your consent at any time, no questions asked: every email includes an unsubscribe link, and you can also write to grow@kakud.ai. Unsubscribing has no consequences for you.
Because we are a US company, your data leaves the European Union and is processed in the United States. That is not an exception or an edge case, it is how this works: the form, the list and the audit all sit with US providers, under US law. US law does not offer the same privacy protections as EU law, and US public authorities may in some circumstances be able to request access to data held by US companies. If you are not comfortable with that, please do not submit the form.
We do not disclose your data to third parties for their own purposes. To store the list and send emails we use service providers acting as data processors:

This website uses no cookies. Not ours, not anyone else's. That is why you will not see a cookie banner: there is nothing to accept.
If you are in the EU, under the GDPR you have the right to:
To exercise any of these rights, email grow@kakud.ai stating which right you want to exercise. We will reply within one month at the latest. We honour these requests wherever you write to us from, EU or not.
If you want to complain to a regulator: we are a US company, so the Spanish data protection authority is not our supervisory authority. If you are in the EU or the EEA, you can lodge a complaint with the data protection authority of the country where you live or work. The full list of national authorities is published by the European Data Protection Board at edpb.europa.eu.
This website and our services are aimed at professionals and businesses, and are not directed to children.
As a US company, we follow COPPA: we do not knowingly collect personal data from anyone under 13 years of age. If you are in the EU or the EEA, the GDPR sets the age of digital consent between 13 and 16 depending on your country, so please only sign up if you are old enough to consent under the law of the country where you live.
If we learn that we have collected data from someone below the applicable age, we delete it.
